A Tentative Profile of "Direct Negotiation" Couples
Certain divorcing couples do well in direct negotiations; others do not. Regardless of your client's personal negotiation skills, if the other spouse is not up to the negotiations, this approach may not work. The following examples may help the lawyer identify which couples have the best chance at directly negotiating significant issues without the active intervention of a lawyer.
Therapists who evaluate couples in conflict have come to recognize four basic types. These types are very well summarized in Ken Kressel's excellent publication, The Processes of Divorce.
